1. Introduction
These Terms and Conditions govern the DirectoryWest Community Grit Bin Pilot Program (the “Program”) operated by DirectoryWest Ltd (“DirectoryWest”) in partnership with the High Knightswood and Anniesland Community Council (“HKA CC”). By submitting an application for a free grit bin, you agree to be bound by these Terms and Conditions.
2. Eligibility
- The Program is open to residents of High Knightswood and Anniesland who meet all of the following criteria:
- Experience difficulty with mobility, particularly during icy conditions.
- Are unable to obtain a grit bin from Glasgow City Council.
- Face financial barriers to acquiring a grit bin.
- Applications that benefit multiple people or households (e.g., residents of small streets, those with shared access) are encouraged.
- Residents facing multiple challenges (e.g., disabilities, health issues, low income) will be given special consideration.
- DirectoryWest and HKA CC reserve the right to determine eligibility and suitability of any application to proceed. An appropriate individual or committee may be appointed for this purpose.
- In case of disagreement between DirectoryWest and HKA CC regarding eligibility or suitability, the final decision rests with the Chair of the Community Council. DirectoryWest retains the right to object to any application that poses a risk of material adverse impact to its business or interests.
3. Application Process
- Eligible residents can apply for a free grit bin through the designated application method (e.g., online form, contacting HKA CC).
- Applications must be submitted by the specified deadline.
- Applications will be reviewed, and recipients will be selected based on the eligibility criteria.
- Due to limited availability, not all eligible applicants may receive a grit bin.
4. Grit Bin Usage
- Grit bins are intended for use on public pavements and walkways adjacent to the recipient’s property to ensure safe passage.
- Grit bins must be stored on private property when not in use. If placed on the public street for access, they must not obstruct or disrupt pedestrians or vehicles.
- Recipients are responsible for using the grit responsibly, sparingly, and only when necessary to ensure safety.
- DirectoryWest may provide additional grit throughout the winter, subject to availability.
- Recipients must comply with all applicable laws and regulations regarding grit bin placement and usage.
5. Liability and Indemnity
- Liability: To the fullest extent permitted by Scots law, DirectoryWest and HKA CC are not liable for any loss, injury, damage, or expense arising from the use or misuse of the grit bins or grit, including but not limited to:
- Personal injury
- Property damage
- Third-party claims
- Indemnity: You agree to indemnify and hold harmless DirectoryWest and HKA CC from and against any and all claims, losses, liabilities, damages, costs, and expenses (including legal fees) arising from your use or misuse of the grit bin or grit, or your breach of these Terms and Conditions.
6. Intellectual Property
- All intellectual property rights in the grit bins and any associated materials remain the property of DirectoryWest or its licensors.
7. Data Protection
- DirectoryWest and HKA CC will process your personal data in accordance with their respective privacy policies and applicable data protection legislation, including the UK GDPR and the Data Protection Act 2018.

8. Termination
- DirectoryWest may terminate the Program or your participation in it at any time for any reason.
- You may withdraw your application at any time by contacting HKA CC.
9. Governing Law and Jurisdiction
- These Terms and Conditions are governed by and construed in accordance with the laws of Scotland.
- Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Scottish courts.
10. Entire Agreement
- These Terms and Conditions constitute the entire agreement between you and DirectoryWest relating to the Program and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
11. Severability
- If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in full force and effect.
12. Waiver
- No waiver of any provision of these Terms and Conditions shall be effective unless in writing and signed by DirectoryWest.
